### Do I need a brokerage account?

No funding, no trading, no risk to your capital — MomoX only ever *reads* the market; it never places trades or touches your money or buying power. Two free connections power it, set up once: an Alpaca market-data account (alpaca.markets — no brokerage, opens in minutes) for the base feed, and a free Schwab brokerage account (schwab.com — no deposit required) that unlocks **100% of US volume in real time**. Set up both — Alpaca alone streams the IEX exchange only, about 2% of US volume. Schwab approves API access by hand, typically 24–72 hrs.

### Is my data private?

Yes. Your Alpaca/Schwab keys live only in your browser — never in an account or database of ours. MomoX uses them to pull *your* live data and passes it straight through; we never store your keys, your positions, or your activity. ### Is the data real-time?

Yes — with the right setup. Alpaca's free feed is real-time but IEX-only (about 2% of US volume): candles form live but thinner than the full tape, with quiet stretches pre-market and after-hours; the full-market history fills in behind on a 16-minute delay. Connect your free Schwab account and you stream **100% of US volume in real time**. That's why setup includes both — Schwab is the real-time experience, Alpaca is the base layer and history.

### Do I have to pay extra for market data?

No. MomoX runs fully on Alpaca's free data — live quotes and market history, at no cost. Alpaca's free tier streams the IEX exchange only (about 2% of US volume), so we have every member connect a free Schwab brokerage account for 100% of US volume in real-time — also free, set up once inside the app. If you'd rather stay on Alpaca, its paid full-market plan works automatically the moment you have one. Here's the key thing — that plan is bought from Alpaca, on your own account, and is completely separate from MomoX. Your MomoX subscription is for the software; your data is your own, and we never charge you for it or require you to upgrade.

### How is this different from TradingView or my broker's charts?

Two ways. First, MomoX isn't a blank chart you spend a year configuring — it comes with a complete momentum system built in: it watches every timeframe at once and tells you the moment a move is real, with the market's biggest positioning and every key level already on your screen. Second, it's built to line up with what your trading platform actually shows you, so your analysis holds up when it's time to execute. And it's private by design — your keys and setup live only in your browser, never in a database of ours.

### Will the bubbles make me profitable?

No. A bubble tells you a cross happened; it doesn't tell you to trade. MomoX3 draws the trend, the squeeze, the day's range and the levels so you can see whether a signal has anything behind it, and the Academy teaches you to read that in order. The tool makes the process visible. Following it is still your job, and trading still carries risk.

## Terms of Service

The full and governing Terms of Service are published at [app.momox.io/terms](https://app.momox.io/terms) and apply to all use of MomoX; by subscribing or using the application you agree to them. The following restates the key terms.

### 1. Who we are

MomoX (also “MomoX3”) is software developed and operated by Clark Trading LLC ("MomoX," "we," "us"). By purchasing a subscription or using the application, you agree to these terms and to the full Terms at app.momox.io/terms.

### 2. Your license

Subject to payment and these terms, you receive a personal, non-exclusive, non-transferable, revocable license for **one named individual** to access and use MomoX for the duration of your paid subscription. You are buying limited access to software — not financial services, market-data entitlements, or investment advice. No rights are granted except the limited use license in this section.

### 3. Intellectual property

All software, source code, designs, user interfaces, algorithms, signal logic, indicators, visualizations, methods, and branding that make up MomoX are the **exclusive intellectual property of Clark Trading LLC**, protected by copyright and other laws, and remain our property at all times. Your subscription conveys no ownership and no license to our intellectual property beyond the limited, personal use granted in Section 2. MomoX's proprietary trading system — including its signals and their underlying logic — is confidential and a trade secret; nothing in these terms transfers it to you.

### 4. What you may not do

You agree not to, and not to help or permit anyone else to:

- **Share access** — your account, credentials, sign-in links, license, or active sessions are for you alone; simultaneous-use limits are enforced technically and contractually.
- **Copy or redistribute** the software or any part of it, in any form.
- **Reverse engineer, decompile, scrape, or extract** the software, its signal logic, or its outputs, including automated collection of signals or data for use outside the app.
- **Build competing or derivative products** using the software, its code, or systematic observation of its outputs.
- **Frame, embed, mirror, or resell** the service or access to it.
- **Probe, disrupt, or circumvent** the service — no security testing, rate-limit or session-limit evasion, or interference with the service or other users.
- **Automate access** — no bots, headless clients, or programmatic use outside the intended interface.

### 5. Monitoring, watermarking, and enforcement

Every session is individually fingerprinted and watermarked, and we log technical signals (including device, session, and coarse location activity) to detect sharing and abuse. You consent to this monitoring. We may **suspend or terminate access immediately and without refund** for violations of these terms, and pursue any other available remedy. Leaked or redistributed copies are traceable to the originating account.

**Liquidated damages for shared access.** Because lost subscription revenue from shared access is real but difficult to measure precisely, you agree that unauthorized use of your access by any additional person will be invoiced at the then-current individual monthly subscription price, per additional person, per month or part-month of shared use — as liquidated damages representing a reasonable pre-estimate of our loss, not a penalty. Termination does not waive our right to recover these or any other damages.

**Enforcement costs.** If we prevail in an action to enforce these terms, you agree to pay our reasonable costs of enforcement and collection, including attorneys' fees.

### 6. Eligibility

You must be at least 18 years old and able to form a binding contract to subscribe.

### 7. Billing and renewal

Subscriptions are billed monthly in U.S. dollars via Stripe, our payment processor, and renew automatically each billing period until canceled. The price in effect for your plan is shown at checkout and on this site. The price of an active subscription does not change while it stays active. If we change list prices, the new prices apply to new subscriptions and to plan changes you choose to make, and we will tell you by email before any change that would affect you.

**Installment lifetime plans.** Some offerings may be sold as a fixed-term installment plan — for example, twelve monthly installments of $200 ($2,400 total) for a lifetime entitlement — alongside a base subscription billed separately. A lifetime entitlement vests only when every scheduled installment has been paid; a missed installment that is not recovered, or any charged-back or disputed payment, voids the unvested entitlement and any associated roles, and amounts already paid are not refundable except as required by law. Installment plans end automatically after the final scheduled payment and do not renew; the accompanying base subscription remains a separate, ongoing subscription.

### 8. Cancellation and refunds

You can cancel at any time as described in our [Refund & Cancellation Policy], which is part of these terms. Lapsed or refunded subscriptions lose access automatically.

### 9. Referral rewards and affiliate program

We run two separate reward programs. **Referral rewards** ("give $25, get $25"): when a friend subscribes through your referral code, they get the stated discount on their first payment and you get an account credit after that payment clears — one reward per referred customer. Credits apply only to your MomoX billing, have no cash value, and are not transferable; self-referral in any form voids the reward.

The **affiliate program** pays cash commissions on qualifying sales through our affiliate platform. Participation is at our discretion; rates, attribution windows, and payout timing are those published in the affiliate dashboard and may change prospectively, and only offers we designate as commissionable earn commissions. Commissions are never earned on your own purchases, and a single sale earns at most **one** reward across both programs — a referral credit or an affiliate commission, never both. Refunds, chargebacks, and fraud reverse the associated reward or commission. Affiliates must avoid misleading claims (including income or performance claims), spam, and bidding on our trademarks; they act as independent contractors responsible for their own taxes.

### 10. Market data and third-party services

MomoX displays market data retrieved through your own data-provider account (e.g. Alpaca, Schwab) under your own credentials and that provider's terms. We pass this data through without storing your credentials; we do not provide, license, or redistribute market data, and we are not responsible for the accuracy, availability, or timeliness of third-party data feeds. Full-market real-time data requires accounts with third-party providers, who approve, deny, delay, or terminate access at their sole discretion — those decisions are outside our control, are not a failure of the service, and are not grounds for a refund; the software remains functional on the base data feed. MomoX is independent software and is not affiliated with, sponsored by, or endorsed by Alpaca, Schwab, or any data provider.

### 11. No investment advice

MomoX provides charting, indicators, and informational signals only. Nothing in the application or on this site constitutes investment, financial, legal, or tax advice, or a recommendation regarding any security or strategy. Markets involve substantial risk of loss. You alone are responsible for your trading decisions and their outcomes. We are not a broker-dealer or investment adviser.

### 12. Warranty disclaimer

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant uninterrupted or error-free operation or the accuracy of any market data or signal.

### 13. Limitation of liability

To the maximum extent permitted by law, Clark Trading LLC will not be liable for trading losses or for any indirect, incidental, special, consequential, or punitive damages arising from your use of MomoX. Our total liability for any claim is limited to the fees you paid us in the twelve months preceding the claim.

### 14. Indemnification

You will indemnify and hold harmless Clark Trading LLC from claims, damages, and costs (including reasonable attorneys' fees) arising from your violation of these terms or misuse of the service.

### 15. Governing law, venue, and changes

These terms are governed by the laws of the State of Wyoming, USA, with exclusive venue in its courts, without regard to conflict-of-law rules. If any provision is unenforceable, the rest remain in effect. We may update these terms; material changes will be posted with a revised date, and the current governing version is always at [app.momox.io/terms](https://app.momox.io/terms). ## Privacy Policy

### What we collect

We collect the minimum needed to run a subscription: your name and email address, and records of your subscription status. Payments are processed by Stripe; your full card details go directly to Stripe and are never stored on our systems. Stripe's handling of your payment data is described in Stripe's own privacy policy.

To secure accounts and prevent sharing and abuse, we also log technical session data tied to your account — device and browser characteristics, IP-based coarse location, and sign-in and session activity. We use this only for security, license enforcement, and fraud prevention, never to build an advertising profile.

### What we deliberately don't collect

- Your Alpaca or Schwab keys — they live only in your browser and are never stored in an account or database of ours.
- Your trading activity, positions, watchlists, or chart drawings — these live in your browser, not in our systems.
- Advertising identifiers or cross-site tracking profiles built by us. This site does load Google Tag Manager (with the Meta pixel and Google Analytics) to measure visits and checkouts; those services set their own cookies under their own policies. A member referral code and the source of your visit are kept in your own browser storage, first party.

### How we use your information

To provide access to the software, process payments, respond to support requests, and send service emails about your account (receipts, renewal notices, important product updates). We do not sell or rent personal information to anyone.

### Sharing

We share data only with service providers necessary to operate MomoX (currently Stripe for payments and our email provider for support and receipts), or when required by law.

### Retention and your rights

We keep account records while your subscription is active and as required for tax and accounting afterward. You can request a copy or deletion of your personal data at any time by emailing [support@momox.io](mailto:support@momox.io); we respond within 30 days. ### Children

MomoX is not directed to anyone under 18, and we do not knowingly collect information from minors.

## Refund & Cancellation Policy

### Canceling your subscription

Cancel anytime: Ask **@SupportX3** on Discord (DM the bot or type /ask in #momox3-support — it escalates to Clark), or email [support@momox.io](mailto:support@momox.io) from the email address on your account. Cancellation stops the next renewal; your access continues through the end of the billing period you've already paid for. No cancellation fees.

### Refunds

Payments are non-refundable except where required by law — canceling stops the next renewal and your access runs through the period you've paid for. The exceptions we'll always make right: a renewal that charged after you'd already asked us to cancel, or a billing error — contact us within 14 days of the charge. A data provider's decision to deny or delay your API access (e.g. Schwab's approval process) is outside our control and isn't grounds for a refund — the app runs on the base feed in the meantime.

### How refunds are issued

Approved refunds are returned to your original payment method via Stripe, typically within 5–10 business days depending on your bank.
